Terms of Service

1. General
These Terms of Service govern the relationship between VIVA Energetica ("the Company") and the client ("the Client") for all electrical services provided, including electrical installation, maintenance, repair, solar installation, and related services in the Costa Blanca region, Alicante, Spain.
By requesting a quote, booking a service, or engaging the Company in any capacity, the Client agrees to these terms.
2. Services
VIVA Energetica provides the following services:
- Installation: Supply and installation of electrical systems, distribution boards, solar PV, EV chargers, and smart home wiring for residential and commercial properties.
- Maintenance: Preventive and scheduled maintenance including electrical inspections, testing, earthing checks, and system diagnostics.
- Repair: Diagnosis and repair of faults, component replacement, and emergency callouts.
- Consultation: On-site assessments, system recommendations, energy efficiency audits, and project planning.
All installations are carried out in accordance with Spanish REBT regulations (Reglamento Electrotécnico de Baja Tensión) and the relevant EU directives.
3. Quotes and Pricing
All quotes are provided free of charge and are valid for 30 days from the date of issue, unless otherwise stated.
Quotes include an itemised breakdown of equipment, materials, labour, and applicable IVA (VAT). Any additional work not included in the original quote will be communicated and agreed upon with the Client before proceeding.
Prices are quoted in Euros and include IVA at the applicable rate.
4. Payment Terms
We accept the following payment methods:
- Bizum
- Bank transfer (Spanish bank account)
- Cash
- Card payment (Visa, Mastercard)
For installations, a deposit of 50% may be required upon confirmation of the order. The remaining balance is due upon completion of the work.
For maintenance contracts, payment is due according to the agreed schedule (monthly, quarterly, or annually).
Late payments may incur interest at the legal rate established under Spanish law.
5. Warranties
All work performed by VIVA Energetica is covered by the following warranties:
- Labour warranty: 2 years from the date of completion, covering defects in workmanship.
- Equipment warranty: As provided by the manufacturer (typically 2-5 years depending on the brand and model). We assist with all manufacturer warranty claims.
- Electrical installation: All installations are covered by the official Boletín Eléctrico certificate as required under Spanish law.
Warranties do not cover damage caused by misuse, negligence, power surges, unauthorised modifications, or failure to maintain the system as recommended.
6. Liability
VIVA Energetica carries professional liability insurance covering all work performed.
Our liability is limited to the value of the services provided. We are not liable for indirect or consequential damages, including but not limited to loss of income, property damage not directly caused by our work, or discomfort due to equipment failure beyond our control.
The Client is responsible for ensuring adequate access to the property and work areas, and for informing us of any existing issues (electrical, structural, plumbing) that may affect the installation.
7. Cancellation and Rescheduling
The Client may cancel or reschedule a booked service under the following conditions:
- More than 48 hours notice: Full refund of any deposit paid.
- Less than 48 hours notice: The deposit may be retained to cover costs already incurred (e.g., equipment ordered, scheduling commitments).
- No-show: If the Client is not available at the agreed time without prior notice, a callout fee may apply.
For equipment that has been specially ordered, cancellation may be subject to restocking fees charged by the supplier.
8. Property Access and Permissions
The Client is responsible for obtaining any necessary permissions for the installation, including community (comunidad) approvals where required, building permits, and access to communal areas.
In accordance with Spanish regulations, all electrical installations must have the required Boletín Eléctrico certificate. VIVA Energetica handles this documentation as part of every installation.
9. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of Spain.
Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the Province of Alicante, Spain.
Consumer rights under Spanish and EU consumer protection legislation are not affected by these terms.

11. Changes to These Terms
VIVA Energetica reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are published constitutes acceptance of the updated terms.
